1. Who we are
This website (audaciousfoods.in and its sub-domains, the "Website") is owned and operated by Audacious Foods Private Limited ("Audacious Foods", "we", "us", "our"), a company incorporated under the Companies Act, 2013, whose identity is set out in the box above. In these terms, "you" refers to any person who visits or uses the Website.
This document is an electronic record under the Information Technology Act, 2000 and does not require a physical signature.
2. Eligibility and acceptance
By using the Website you confirm that you are at least 18 years old and legally capable of entering into a contract under the Indian Contract Act, 1872. If you use the Website on behalf of an organisation, you confirm you are authorised to bind that organisation. If you do not agree to these terms, please do not use the Website.
3. The Website and our waitlist
Audacious Foods is currently in a pre-launch phase. The Website today provides brand and product information and lets you join our waitlist. Joining the waitlist does not create any obligation to buy, or any obligation on us to supply. When we begin selling directly, the ordering, pricing, delivery and refund terms below will apply to those purchases.
4. Products, descriptions and claims
Our products are premium treats & desserts made without refined sugar, sweetened with alternatives to it. "No refined sugar" refers to the absence of added refined sugar (such as white or brown table sugar); our products may contain naturally occurring sugars, including those present in dairy and fruit.
Allergen notice. Our products may contain or be made in facilities that handle nuts, dairy and gluten. If you have a food allergy or intolerance, please check product packaging and labelling before consuming.
Information on the Website is provided for general information only and is not medical, nutritional or dietary advice. It is not intended to diagnose, treat or prevent any condition. Please consult a qualified professional for advice specific to you. We take reasonable care to describe products accurately, but colours, images and packaging are indicative and may vary.
5. Orders, pricing and payment
Once direct ordering is available, all prices are listed in Indian Rupees (INR) and are inclusive or exclusive of applicable taxes as indicated at checkout. We may change prices, or correct pricing errors, at any time before we accept your order. An order is a request to purchase; a contract is formed only when we confirm acceptance. Payments are processed by third-party payment gateways, and your use of those services is subject to their terms. We do not store your full card or banking details.
6. Delivery, cancellations, returns and refunds
Because our products are food items, they are generally not eligible for return or exchange once delivered, except where an item arrives damaged, defective, spoilt or incorrect. In such cases, please contact us within 24 hours of delivery with your order details and photographs, and we will offer a replacement or refund at our discretion. Delivery timelines are estimates and may vary. Detailed shipping and refund terms will be published when direct ordering goes live.
7. Intellectual property
All content on the Website — including the Audacious Foods name and logo, text, graphics, images, product designs, recipes, and the look and feel of the Website — is owned by or licensed to Audacious Foods and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute or create derivative works from any part of the Website without our prior written consent.
8. Acceptable use
You agree not to use the Website to: violate any law; infringe our or any third party’s rights; upload harmful code; attempt to gain unauthorised access to our systems; or use automated means to scrape or disrupt the Website. We may suspend or restrict access if we reasonably believe you have breached these terms.
9. Third-party links and marketplaces
The Website may link to third-party platforms, including quick-commerce and marketplace partners through which our products are sold. We are not responsible for the content, policies or practices of those third parties, and your dealings with them are governed by their own terms.
10. Disclaimers and limitation of liability
The Website is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties and do not warrant that the Website will be uninterrupted or error-free. To the extent permitted by law, our aggregate liability arising out of or relating to the Website or any product shall not exceed the amount you paid for the relevant product. Nothing in these terms limits any liability that cannot be limited under applicable law, including under the Consumer Protection Act, 2019.
11. Indemnity
You agree to indemnify and hold harmless Audacious Foods and its directors, officers and employees from any claims, losses or expenses arising out of your breach of these terms or your misuse of the Website.
12. Governing law and jurisdiction
These terms are governed by the laws of India. Subject to any rights you have under consumer protection law, the courts at Kolkata, West Bengal shall have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Website.
